Terms and Conditions

1. Campaign overview
“Lowest Price” is a promotional value campaign on selected tagged products only. It applies only to products identified in store by Gong Grocer as participating in the campaign. It is not a representation that Gong Grocer offers low prices across all products, categories, or competitors.

2. Selected products only
The campaign applies only to products displaying a “Lowest Price” ticket, shelf talker, or other Gong Grocer campaign signage. Product may vary by availability and campaign period.

3. Basis of claim
Where a tagged product includes a comparative statement such as:

• “Lowest Price”

• “$1 less than nearby major supermarkets”

• “Price checked on [date]”

that statement applies only to the specific product shown on the ticket, including the same brand, size, flavour, variety, weight, and pack configuration. For example below:

4. Price comparison method
Comparisons are based on a price check conducted by Gong Grocer against a nearby major supermarket on the date shown on the relevant sign. The comparison is based on the competitor’s price for an identical product available at the time of checking.

5. Date-specific comparison
Any comparative pricing claim is valid only as at the “Price checked on” date shown on the ticket. Competitor pricing may change after that date. Gong Grocer does not warrant that the competitor price will remain the same after the stated check date.

6. Lowest Price meaning
For the purposes of this campaign, “Lowest Price” means Gong Grocer has identified that the tagged product was priced lower than the compared nearby major supermarket on the date checked, based on Gong Grocer’s internal review of that identical product. It does not mean Gong Grocer is the lowest-priced retailer generally, or that all Gong Grocer prices are lower than competitors.

7. Exclusions from comparison
Comparisons do not include or apply to:

• non-identical items

• different sizes, weights, flavours, or pack formats

• clearance, short-dated, damaged, or liquidation stock

• multi-buy offers, bundle offers, coupon offers, app-only offers, or promo code offers

• member-only or loyalty pricing

• online-only offers, delivery-inclusive offers, or marketplace sellers

• wholesale, trade, or bulk-volume pricing

8. Stock availability
All tagged products are subject to stock availability. A product being marked as Lowest Price does not guarantee stock availability for any period.

9. Signage changes and corrections
Gong Grocer may update, correct, suspend, or remove campaign signage, comparative claims, or participating products at any time, including where competitor prices change, stock becomes unavailable, a comparison is no longer exact, or an error is identified.

10. No price match or guarantee unless stated
This campaign is not a price match or a whole-store price guarantee unless Gong Grocer expressly states otherwise in separate written terms.

11. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any rights a consumer may have under the Australian Consumer Law.
